Terms of Service

These Terms of Service ("Terms") govern your use of the Talfan platform. By signing up, clicking "I agree", or otherwise using Talfan, you accept these Terms on behalf of yourself and, if applicable, the business entity you represent ("Customer", "you").

1. The service

Talfan provides a multi-channel customer support platform that connects to WhatsApp Business (via Meta's Cloud API and the Coexistence flow), voice, email, and other messaging channels, and layers AI drafting, routing, and analytics on top ("Service"). Talfan is an independent software provider and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

Customer retains all rights to data uploaded to, or processed through, the Service ("Customer Data"). Customer grants Talfan a limited licence to process Customer Data solely to provide and improve the Service, consistent with our Privacy Policy and the Data Processing Addendum available on request.

We may suspend or terminate Service for breach, abuse, or risk to Meta's platform integrity. Repeat or severe violations result in permanent termination without refund.

Talfan and its licensors own all rights, title, and interest in the Service, including software, trademarks, and documentation. Customer Data remains yours. Feedback you send us may be used without obligation.

8. Confidentiality

Each party will protect the other's non-public information with the same care it uses for its own (and no less than reasonable care), and only use it to perform under these Terms.

9. Warranties and disclaimer

Talfan warrants that the Service will perform materially as described in our public documentation. Except for that, the Service is provided "as is". We disclaim all other warranties to the extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. AI-generated outputs may be incorrect — review drafts before sending to customers.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, or lost profits. Each party's total liability under these Terms is capped at the fees Customer paid to Talfan in the twelve months before the event giving rise to the claim. Nothing in this clause limits liability that cannot be limited by law (e.g. willful misconduct, data-protection statutory liability).

11. Indemnities

Customer will defend Talfan against third-party claims arising from Customer Data, misuse of the Service, or violation of Meta's policies, and pay any resulting damages and reasonable attorneys' fees. Talfan will defend Customer against third-party claims that the Service itself infringes their IP rights.

13. Changes to the Service and Terms

We may update the Service and these Terms. Material changes to the Terms will be announced at least 14 days in advance by email to tenant admins. Continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction where Talfan is established, without regard to conflicts-of-laws rules. Disputes go to the courts of that jurisdiction, unless mandatory consumer or data-protection rules provide otherwise.
